This proposed motion is improper and not legal. Erie doesn’t currently have eminent domain authority. Malcolm has stated eminent domain would be one of the key powers Erie would gain should Home Rule pass. So without this current authority, the town cannot include language referencing this in a motion passed prior to the home rule vote.
